These Terms of Use apply to all users who use the "LilMe Tales" application of Phan & Gruschka GbR.

The use of the "LilMe Tales" application requires registration. This registration is also possible anonymously via the app and is automatically executed. With the registration or the download of the app, the user accepts these terms of use as well as the general terms and conditions and the privacy policy.
The user is responsible for the accuracy of the data provided during registration and undertakes to communicate changes immediately.

Phan & Gruschka GbR reserves the right to terminate a user account under certain circumstances. This can, for example, be the case when these terms of use, the general terms and conditions or the privacy policy are violated.
In the event of account termination, the user's personal data will be handled in accordance with legal provisions and our privacy policy.

The copyright of the stories generated with the help of the "LilMe Tales" online application lies with Phan & Gruschka GbR.
Phan & Gruschka GbR grants the user a simple, non-transferable right of use for the created stories, which allows the user to read, store, and use the stories for personal, non-commercial use. Any use beyond this, in particular reproduction, distribution, public access or editing of the stories, requires the express consent of Phan & Gruschka GbR.

The user is responsible for complying with the rules and conditions set out in the terms and conditions as well as these terms of use.
The user undertakes to use the "LilMe Tales" online application exclusively for personal, non-commercial use and not to perform any actions that violate applicable law, the rights of third parties, or good morals.

The "LilMe Tales" application may contain links to websites or services of third parties. Phan & Gruschka GbR is not responsible for the content or practices of these third parties.
Users are encouraged to read and understand the terms of use and privacy policies of these third parties before using their websites or services.

Phan & Gruschka GbR is liable in accordance with the liability rules laid down in the terms and conditions.
Phan & Gruschka GbR makes no guarantee for uninterrupted availability, the absence of errors or the suitability of the generated stories for a specific purpose.

Phan & Gruschka GbR commits itself to comply with data protection regulations and to collect, process and use the personal data of users only within the framework of legal regulations. Further information on the collection, processing and use of personal data can be found in the privacy policy, which can be accessed on the website or via the app of the provider.

Phan & Gruschka GbR is liable according to statutory provisions for intent and gross negligence. In the case of slight negligence, Phan & Gruschka GbR is only liable in the event of a breach of a major contractual obligation (cardinal duty) and limited to the foreseeable, contract-typical damage.
Liability for indirect damage and lost profits is excluded in the case of slight negligence.
The limitations of liability do not apply in case of injury to life, body and health, for claims under the Product Liability Act, and in the case of taking over a quality guarantee.
Phan & Gruschka GbR assumes no liability for the content of stories generated by the AI. These stories are generated automatically and without human intervention. Users are reminded that the generated stories are random and Phan & Gruschka GbR has no influence over the specific content.
The use of the service by minors should be supervised by adults. Phan & Gruschka GbR recommends that only users aged 13 and above should use the service.

Phan & Gruschka GbR reserves the right to change these terms of use at any time. The user will be informed about significant changes to the terms of use.
If the user does not agree with the changes, he/she can terminate the contract with Phan & Gruschka GbR at any time.

Phan & Gruschka GbR reserves the right to update, change or discontinue the "LilMe Tales" online application at any time. The user will be informed about significant changes or the discontinuation of the application.

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If individual provisions of these terms of use are or become ineffective or unenforceable, the effectiveness of the remaining provisions remains unaffected.
Changes and additions to these terms of use require written form. This also applies to the amendment of this clause requiring written form.
If the user is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the business location of Phan & Gruschka GbR. The same applies if the user does not have a general jurisdiction in Germany or if the residence or habitual residence is unknown at the time of filing the lawsuit.
